What the VT-005 is and why it matters

VT-005 is Vermont's Bill of Sale and Odometer Disclosure Statement: a bill of sale on the front and a full odometer statement on the back. The DMV's form list describes it as the form to transfer ownership of a motor vehicle and state current mileage, and says the odometer statement is required for model year 2011 or newer.

On many dealer sales you won't need the back page. The DMV says all Vermont titles conform with the federal Truth in Mileage Act, and a separate odometer statement is unnecessary for a conforming title that's properly assigned and completed. This guide covers when the VT-005 is still needed, both pages box by box, and the federal rules that sit behind it.

The current revision is VT-005 (01/2022), a two-page PDF from the Vermont DMV: a bill of sale on page one and the Odometer Disclosure Statement on page two. The PDF is fillable, so you can upload it to DealerVLO once under Settings → Forms. Many boxes are one field printed on both pages (vehicle, mileage, seller and buyer names and addresses), so one mapping fills both sides. Check the suggested mapping before you save it: the co-owner box should point at the co-buyer's name and the seller phone box at your dealership phone. The miles/kilometers/hours box is a single field with three states, and DealerVLO has no setting for which unit applies, so leave it unmapped and tick it by hand. The signature lines aren't fields.

Documents to have before you start

Gather these before you complete the VT-005. A missing attachment is the number-one reason the the Vermont Department of Motor Vehicles bounces a title application back.

  • The title or MCO you're transferring — Check its odometer section first. The DMV says a properly assigned conforming title doesn't need a separate statement.
  • The VD-119 application — Its odometer reading should match the VT-005. See the VD-119 guide.
  • Bills of sale for the full chain of ownership, when the vehicle wasn't previously titled — The DMV's title guide says they must show make, year, VIN, purchase price, mileage, the seller's signature and the date of sale.

When a Vermont dealer needs the VT-005

The DMV's title guide lists an odometer disclosure statement for model year 2011 and newer in each of its scenarios: a new vehicle on an MCO, a used vehicle with a previous title, and a used vehicle that was never titled. Its Truth in Mileage Act page then says a separate statement is unnecessary for a conforming title that's properly assigned and completed, and that all Vermont titles conform. So on a typical used sale you disclose on the title and on the VD-119, and the VT-005's back page is for when the ownership document can't carry a proper disclosure. The front also works as a bill of sale. The top of the form says it plainly: for model year 2011 or newer, if you aren't submitting a separate odometer statement, complete the one on the back.

Page 1: seller, vehicle and mileage

The top line is the seller: your dealership name on a retail sale. Then year, make, model, body type, color and VIN, copied from the title. Vessel length is for boats; leave it blank on a car. Enter the odometer reading with no tenths and tick Miles, Kilometers or Hours. In the PDF the reading ("miles") and the vehicle boxes are the same fields as on page two, so they fill once for both pages.

Next is the new owner and co-owner, the date and the price. Then a yes/no question: has the vehicle failed an emissions test and been granted a time extension waiver in the past 12 months? The form notes a vehicle may not have two consecutive time extension waivers. The salvage box only gets completed if the vehicle is salvage, salvage and rebuilt, or declared a total loss by an insurer. The form quotes 23 V.S.A. § 2093: the seller has to disclose this orally and in writing before the sale, and if the seller doesn't, the buyer can choose to get a refund of the price, taxes and fees. If you complete it, at least one new owner signs and dates it.

Page 1: lien-free statement and signatures

The seller certifies that the vehicle is free of all liens and encumbrances, under penalty of 23 V.S.A. sections 202, 203, 2082 and 3829(4). Then seller and buyer signature blocks, each with a date, address, city, state, ZIP, phone and email. The front says that if the vehicle is jointly owned, both owners must sign. On a dealer sale an authorized representative signs for the dealership and adds a title. The address and phone boxes are shared with page two.

Page 2: the Odometer Disclosure Statement

Section 1 repeats the vehicle. Section 2 is the reading (no tenths) and one of three statements: reflects the actual mileage, reflects the mileage in excess of the odometer's mechanical limits, or is not the actual mileage, with the discrepancy warning. These are three separate checkboxes in the PDF ("Check Box6.0" to "6.2"), so you can map them to DealerVLO's three odometer status options. Section 3 is the seller's name, phone, address, signature and date. Section 4 is the buyer's. The page says signatures from both the buyer and seller are required, and that if the vehicle is jointly owned only one seller signature is required.

Model years, penalties and your records

The form's footnote explains the 20-year rule: as of January 1, 2021, model year 2011 and newer vehicles are subject to odometer disclosure for 20 years, so a 2011 needs a disclosure until 2031, a 2012 until 2032, and so on. The DMV says model year 2010 and older stay exempt. The back page adds that the statement is for self-propelled vehicles with a registered weight of 16,000 lbs. or less, and that an inaccurate or missing statement can mean fines or imprisonment under 49 U.S.C. § 32709 and Vermont's Consumer Fraud Law. The form doesn't cover record keeping. The federal rule does: a dealer keeps a copy of every odometer statement it issues and receives for five years (49 CFR 580.8).

Common VT-005 mistakes that cause rejections

Filling out the back page on every sale

The DMV says a properly assigned conforming title doesn't need a separate statement. Use the back when the ownership document can't carry the disclosure.

Saving the auto-suggested mapping without checking it

Confirm the co-owner box points at the co-buyer's name and the seller phone box at your dealership phone. Map the sale date, the price, and the three odometer checkboxes by hand.

Ticking more than one odometer statement

The form says check one. Leave the other two blank.

Skipping the salvage box on a rebuilt or total-loss car

Under 23 V.S.A. § 2093, a missed salvage or total-loss disclosure lets the buyer choose a refund of the price, taxes and fees. Disclose orally and in writing before the sale, and get a new owner's signature in that section.

Missing the buyer's signature on page two

The odometer statement says signatures from both the buyer and seller are required.

Common questions

Where do I get a Vermont odometer disclosure statement?+

It's the back page of form VT-005, the Bill of Sale and Odometer Disclosure Statement, a free fillable PDF on dmv.vermont.gov. The current revision is 01/2022. The download button at the top of this guide links straight to it.

Do I need a VT-005 if the title has an odometer section?+

Usually not. The Vermont DMV says all Vermont titles conform with the federal Truth in Mileage Act, and a separate odometer statement is unnecessary for a conforming title that's properly assigned and completed.

Which vehicles need an odometer disclosure in Vermont?+

Model year 2011 and newer, for 20 years: a 2011 until 2031, a 2012 until 2032, and so on. Model year 2010 and older are exempt. The form also limits it to self-propelled vehicles with a registered weight of 16,000 lbs. or less.

Does the VT-005 need a notary?+

The form has no notary block. It's certified under penalty of 23 V.S.A. sections 202, 203, 2082 and 3829(4).

If a car is jointly owned, do both owners sign the VT-005?+

The two pages say different things. The bill of sale on the front says both owners must sign. The odometer statement on the back says only one seller signature is required. On a trade-in with two owners, the safe move is to have both sign the front.

How long do Vermont dealers keep odometer statements?+

The form doesn't say. Federal law requires dealers to keep a copy of every odometer statement they issue and receive for five years (49 CFR 580.8).
