What the TC 96-336 is and why it matters

The TC 96-336 is the Kentucky vehicle power of attorney form. The owner (or lessee) appoints an attorney-in-fact who may apply for original or replacement titles, disclose the most current mileage, and transfer title. On a dealer deal, your buyer appoints your dealership. Section 1 is the vehicle they're buying, Section 2 is their trade-in, so one form covers both. The form's instruction is short: attach it to the title and registration application and forward it to the county clerk.

Two rules decide whether it holds up. The owner certifies the power of attorney "was completely filled in at the time of its execution," so nothing gets added after they sign. And Section 4 is a notary section: the notary certifies the owner signed in the notary's presence and was identified by photo ID. This guide walks all four sections from the dealer's side.

The current revision is TC 96-336 (Rev. 05/2022), from the Kentucky Transportation Cabinet, Division of Motor Vehicle Licensing. Copies marked Rev. 05/2020 still circulate online, so check the revision in the top corner. The Cabinet says it prescribes the form for vehicle ownership transfers in compliance with KRS 186A.215 and KRS 457.030(4). Unlike most states' general powers of attorney, this one covers mileage: the owner appoints an attorney-in-fact to apply for title, disclose the current mileage, and transfer title, for a purchased vehicle and a trade-in on one page.

Documents to have before you start

Gather these before you complete the TC 96-336. A missing attachment is the number-one reason the the Kentucky Transportation Cabinet, Division of Motor Vehicle Licensing bounces a title application back.

  • The TC 96-182 title application for the deal — The form says to attach it to the title and registration application. See the TC 96-182 guide.
  • The current odometer reading for each vehicle — Section 1 and Section 2 each state "The vehicle's odometer reading is ___." Read the odometer on the day the owner signs.
  • The owner's photo ID, for the notary — The notary records the form of positive picture identification. A driver's license is marked preferred.
  • A notary present when the owner signs — Section 4 certifies the owner executed the form in the notary's presence.

Section 1: Purchased vehicle information

Year, make, model, VIN, body type, and current plate number for the vehicle being bought, then "The vehicle's odometer reading is ___." Copy the vehicle details from the title so they match the TC 96-182. Write the plate number if the vehicle has one, since the owner certifies the form was completely filled in when they signed. Write the mileage as the odometer reads today.

The same boxes for the trade-in: year, make, model, current plate number, VIN, body type, and the trade's odometer reading. This lets your dealership transfer the trade's title and disclose its mileage as the owner's attorney-in-fact. No trade-in, leave Section 2 empty.

Section 3: Vehicle owner or lessee information and statement

The owner's printed name, email address, phone, street address, city, state, and ZIP. Then "I/we (vehicle owner name), appoint (attorney-in-fact full legal name)" with the attorney-in-fact's address, city, state, and ZIP. When your dealership is appointed, use its full legal name. The form is written "I/we" with two owner signature lines, so a buyer and co-buyer can sign the same form. The grant covers any documents needed to complete the transfer, including applications for original or duplicate title, registrations, license plates, registration renewals, and mileage verifications.

The two odometer certification boxes

"Only mark this section if the vehicle complies with one of the designations below." One box certifies the odometer reading reflects mileage in excess of its mechanical limits. The other certifies the reading is NOT the actual mileage, with "WARNING-ODOMETER DISCREPANCY." These are the owner's certifications about their vehicle, so the owner decides. Leave both blank when the reading is the actual mileage.

Vehicle Owner 1 signs and dates; Vehicle Owner 2 signs and dates when there's a second owner. Right above the signature lines, the owner certifies the power of attorney was completely filled in at the time it was signed. Fill every line that applies before the owner picks up the pen. Sign in front of the notary, not before.

Common TC 96-336 mistakes that cause rejections

Leaving lines to finish after the owner signs

The owner certifies the form was completely filled in when it was signed. Fill the plate numbers, body types, and mileage first.

Owner signs before meeting the notary

The notary certifies the owner executed the form in the notary's presence. Sign at the notary's desk.

Checking a mileage box for the owner

The two boxes are the owner's own certifications. Mark one only if it's true, and only the owner decides.

A separate form for the trade-in

Section 2 is built for the trade-in. One TC 96-336 covers the purchased vehicle and the trade.
